Justice Alexandre de Moraes Orders Restoration of X in Brazil Within 24 Hours

Social media platform X is set to be reinstated in Brazil within 24 hours, following an October 8 ruling by Justice Alexandre de Moraes.

X was originally suspended on August 30 for failing to comply with court orders tied to an investigation into the spread of misinformation across the country.

In his ruling, Justice Moraes stated, “I order the immediate end of the suspension and authorize the platform’s operations to resume under X Brasil Internet Ltda. in Brazil. I also direct Anatel (National Telecommunications Agency) to ensure this ruling is carried out and to submit a report to this Supreme Court within 24 hours.”

A fine related to the case was officially paid on October 7 after a strange situation occurred earlier. On October 4, the funds connected to the penalties imposed on the social media platform were accidentally transferred to the wrong bank account.

The correct transfer was later made, with payments coming from Elon Musk’s satellite company, Starlink.

After months of non-compliance with court orders, X has recently started adhering to Brazilian regulations. The platform has appointed a new legal representative in the country, as required by local law, and has begun suspending accounts that were linked to spreading false information regarding Brazil’s electoral process and legal system.

Justice Moraes has been probing X since 2023 for its role in allegedly aiding the spread of misinformation. Musk himself faces multiple investigations, including charges of obstructing justice, being part of a criminal organization, and inciting criminal behavior.

The conflict is tied to Brazil’s most recent presidential election. In January 2023, supporters of former President Jair Bolsonaro stormed government buildings in a failed coup attempt, calling for the election to be overturned, in a manner similar to the events of January 6 in the U.S.

Brazil’s Supreme Court and Justice Moraes have accused Bolsonaro of inciting the unrest, fueled by false information and fake news circulating online.

In August, X announced its intent to close its Brazil-based operations, though the platform remained available to its Brazilian users. This led to heightened tensions with the Supreme Court, which culminated in the platform’s full suspension days later.

Musk has been vocal in his opposition to Justice Moraes, accusing him of using “illegal” methods to force the platform into censoring content. He has previously called Moraes a “dictator” and claimed the court’s actions amount to political censorship.
