This collaborative effort saw them filing a shared amicus brief with the Supreme Court of the United States, expressing deep concerns about the disparate outcomes emerging from these administrative proceedings. The heart of the matter revolves around the SEC vs. Jarkesy case, where George Jarkesy contends that his Seventh Amendment rights to a jury trial were violated. He argues that the absence of a jury in the SEC’s internal adjudication process infringes upon these constitutional rights, allowing a single entity to act as judge, jury, and enforcer.

The legal challenge gains significance against the backdrop of a noticeable shift in the SEC’s approach, particularly between 2013 and 2014. During this period, the SEC began handling more cases internally rather than through federal courts, a change believed to stem from a series of unsuccessful insider trading cases tried before juries.

Elon Musk, currently embroiled in his third legal battle with the SEC, is at the forefront of this challenge. The regulatory body seeks Musk’s testimony regarding his Twitter acquisition, specifically focusing on his public statements about the transaction.
